PRIVACY POLICY Important information about the processing of personal data

1.1. For the purpose of fulfilling the contract concluded with the parent, Kloogaranna Koduhoid processes the following personal data concerning the parents and the child: 

1.1.1. first and last name of parent and child;

1.1.2.parent’s and child’s personal code;

1.1.3. contact details of the parent – telephone number, home address, e-mail address; 1.1.4. bank account of the parent;

1.1.5. photos of the child’s activities in daycare or kindergarten; 1.1.6. special personal data (child’s health data).

1.2. The parent provides the personal data specified in points 1.1.1 to 1.1.4 and 1.1.6 when concluding the contract, and the provision of personal data is a prerequisite for concluding the contract. If personal data is not provided, Kloogaranna Koduhoid may refuse to conclude a contract.

1.3. In section 1.1.5, the parent’s consent is requested when concluding the contract. 

1.4. A parent without a contractual relationship is possible in clauses 1.1.1. and 1.1.3 processing of personal data by Kloogaranna Koduhoid in the event that a parent wishes to subscribe to the Kloogaranna Koduhoid newsletter, either on the website or at customer events. 

1.5. Kloogaranna Kodhoid processes general data based on Article 6(1)(b) of the General Regulation on the Protection of Personal Data of the European Union to fulfill a contract without asking for consent, to send newsletters based on Article 6(1)(e) of the parent’s e-mail address and on the basis of legitimate interest, and on the basis of Article 9(2) of the child’s health data (a) subject to the consent sought.

1.6. Kloogaranna Koduhoid has a legitimate interest in sending newsletters to parents, which results from the contractual relationship between the parties. Newsletters introduce services similar to the contract concluded with the parent. Newsletters do not create any obligations for the parent and the parent has the right to opt out of receiving newsletters at any time, therefore the parent’s rights and freedoms do not outweigh Kloogaranna Koduhoid’s interest in introducing new services to existing customers.

1.7. Regarding the processing of personal data based on consent, the parent has the right to withdraw consent at any time by submitting a signed request to Kloogaranna Koduhoid via e-mail or to the e-mail address: Kloogarannakoduhoid@gmail.com

1.8. Withdrawal of consent does not render unlawful the processing of personal data that took place until the withdrawal of consent. 

1.9. Regardless of the withdrawal of consent, Kloogaranna Koduhoid may continue to process personal data if there is a legal basis for processing personal data (or part of it) other than consent. 1.10. Kloogaranna Home Care stores personal data obtained during the performance of the contract for 3 years from the termination of the contract. 

1.11. Kloogaranna Koduhoid does not transfer personal data obtained during the performance of the contract to third parties or to third countries.

2. Parent’s data protection rights

2.1. The parent has the following rights in connection with the processing of personal data:

2.1.1. the right to request access to personal data about yourself and your child; 2.1.2. the right to request data correction;

2.1.3. the right to request deletion of data;

2.1.4. the right to limit the processing of personal data;

2.1.5. the right to object to the processing of personal data;

2.1.6. the right to request the transfer of personal data;

2.1.7. the right to submit a complaint to the data protection supervisory authority.

2.2. The use of the above rights is subject to the requirements and restrictions arising from the General Regulation on the Protection of Personal Data of the European Union and Estonian law. 

2.3. In order to use the right, the parent submits a written or e-mail request to Kloogaranna Koduhoi at the email address: Kloogarannakoduhoid@gmail.com, specifying what kind of right is requested. If necessary, Kloogaranna Koduhoid asks the parent for additional information that is necessary to process the request. 

2.4. If the prerequisites for exercising the right are met, Kloogaranna Koduhoid will fulfill the request within 1 (one) month from the receipt of the request. If necessary, Kloogaranna Koduhoid can extend the deadline for resolving the application by 2 (two) months by notifying the parent. 

2.5. If Kloogaranna Koduhoid has grounds for refusing to fulfill the request, Kloogaranna Koduhoid will send a reasoned refusal decision within the time limit specified in point 2.4.

3. Direct marketing 3.1. The parent has the right to refuse to receive newsletters at any time and to prohibit the use of their personal data for direct marketing. 

3.2. To opt out of newsletters, a person can click on the “opt out of further newsletters” link at the end of the newsletter.

3.3. If the parent wants to start receiving newsletters again, it is enough to resubscribe to the newsletter on the Kloogaranna Koduhoid website
